1. A federal district judge would love to get the case. 90%+ of their cases deal with more mundane matters than the Brady case.
2. Courts do accommodate parties' schedules in setting hearings and such.

Neal was right that Brady probably loses, but it is because courts rarely get involved in reviewing arbitration decisions.
