Why can’t the unlimited transfer issue be resolved in the NIL contract? NIL contract A is for X amount of money with the ability to transfer but transferring results in a clawback of NIL funds. NIL contract B is for more money but prohibits transferring. Transferring breaches contract and results in clawback of funds plus penalties for breaching. The NCAA cannot prevent an athlete from contracting away their right to transfer for NIL funds.
