A legal complaint would give the league subpoena power.
All parties would/could deposed under oath - including Brady - and his cell phone. Once you hit "send" those texts stay in the phone. You cannot delete them - right along with emails. They live in that hard drive infinitely. Been there.
Kinda like a school suing the NCAA for probation - can't do it. Perjury would have to be rampant - and there are always those that will be truthful.
