Lets suppose a player is visiting at a friends house

It is in the spring and they are watching an NBA team on TV. Both are 21 yrs old and they each drank 3 beers.

The visitor, a scholarship athlete, decides he better not drive home because he may register a .08 on a breathalyzer. He knows if he stays over that it is a violation of NCAA rules and he could miss over half his season. He thinks, I will call a friend to come and drive me home. However, this could be an improper benefit. I mean, receiving a free ride from a friend?

What can he do? What should he do?
